1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and LilFrito ("LilFrito," "we," "us," "our"). By using any feature of the Platform, you confirm that you have read, understood, and agree to these Terms in their entirety. We reserve the right to update or modify these Terms at any time. Continued use of the Platform after changes constitutes your acceptance of the revised Terms.

2. Eligibility & Age Requirements

LilFrito has different access levels depending on your age. By using any part of the Platform you confirm you meet the requirements for the features you use.

Under 13 — Not Permitted. We do not knowingly collect personal information from children under the age of 13, and access to this Platform is not permitted for users under 13. If we become aware that a user under 13 has created an account or provided personal information, we will delete it promptly. If you believe a child under 13 has created an account, contact us immediately at lilfritoxrp@gmail.com.

Ages 13–17 — Limited Access. Users aged 13–17 may use the Platform's general features — including arcade games, flame generation, meme browsing, the animated series, and community participation — with the explicit consent and supervision of a parent or legal guardian. Users in this age group are strictly prohibited from: purchasing tokens, connecting an XRPL wallet, minting NFTs, entering XRP giveaway eligibility, purchasing merchandise, or engaging in any XRP-related or financial activity on the Platform. By creating an account, users aged 13–17 represent that their parent or guardian has reviewed and consented to these Terms on their behalf.

18 and Older — Full Access. You must be at least 18 years of age to connect a wallet, purchase tokens, mint NFTs, receive XRP giveaway distributions, or engage in any XRP-related or financial activity on the Platform.

Legal capacity. By using the Platform you represent that you have the legal capacity to agree to these Terms under the laws of your jurisdiction, or that your parent or guardian has done so on your behalf.

Jurisdictional compliance. You are solely responsible for determining whether using this Platform is lawful in your country, state, or jurisdiction. We make no representations that any feature of this Platform is available or lawful in any specific location.

Right to restrict. We reserve the right to deny access to any user, from any location, at any time, for any reason, without notice or liability.

3. Accounts — Email & Wallet

LilFrito supports two account types. Both types have access to the Platform's general features — games, flame generation, community competitions, and XP tracking — subject to the age-based restrictions in §2. The account type you choose determines how you sign in and how you can receive XRP giveaways.

Email Accounts. You may create an account using an email address and password. Your credentials are managed securely by Supabase Auth — we do not store your raw password at any time. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. If you lose access to your email account, use the password reset flow on the login screen. We cannot manually recover account access. Email accounts are assigned a platform identifier for token and XP tracking. To receive XRP giveaway distributions, you must link a valid XRPL wallet address to your email account. Email accounts without a linked wallet are not eligible to receive XRP.

Wallet Accounts. You may alternatively connect an XRP Ledger (XRPL) wallet — such as a Xaman wallet — directly as your platform identity. Your wallet address serves as your unique account identifier. You are entirely responsible for the security of your private keys and seed phrase, and for maintaining continuous access to your wallet. We do not store, access, or manage your private keys under any circumstances. If you lose access to your wallet, we cannot recover your account, tokens, XP, Flame history, or any in-platform assets. We bear no liability for losses resulting from lost, stolen, or compromised wallet access.

Linking Wallets to Email Accounts. Email account holders may optionally link an XRPL wallet to enable XRP giveaway eligibility and NFT minting. You may only link a wallet you legitimately own and control. Linking a wallet belonging to another person, or misrepresenting wallet ownership, is a violation of these Terms and grounds for permanent account termination.

One Account Per Person. Each person may maintain only one active account, regardless of type. Creating multiple accounts — whether email, wallet, or a combination — to gain additional competition entries, tokens, XP, or giveaway eligibility is strictly prohibited and will result in permanent termination of all associated accounts.

By linking your wallet to Frito's Nest Discord, you consent to us storing the association between your Discord ID and wallet address. You may remove this link at any time via /unlink.

4. Frito Flame Factory — AI Image Generation

The Frito Flame Factory is an AI-powered image generation service that creates LilFrito-branded digital artwork ("Flames") using third-party AI models. Generating a Flame may require spending platform tokens. Free daily tokens are provided to ensure access at no cost.

You retain a personal, non-exclusive, non-commercial license to display and use the Flames you generate. You grant LilFrito a perpetual, irrevocable, worldwide, royalty-free license to display, reproduce, share, and promote any Flame generated on the Platform.

We make no guarantee that any Flame is unique or distinct from Flames generated by others. You may not use the Flame Factory to generate content depicting real individuals without consent, sexually explicit or obscene content, content promoting hate speech or illegal activity, or content infringing third-party intellectual property. We reserve the right to remove any Flame that violates these standards without notice or refund.

Image generation is powered by third-party AI providers. We are not responsible for their behavior, availability, or outputs.

5. Frito Flames — Minting as NFTs

Users may optionally mint their AI-generated Flames or community board drops as NFTs ("Frito Flames NFTs") on the XRP Ledger. Minting is entirely voluntary.

Wallet required for minting. Regardless of account type, minting an NFT on the XRP Ledger requires a valid linked XRPL wallet address. Email account holders must link an XRPL wallet before initiating any mint. We are not responsible for delays or missed opportunities resulting from failure to link a wallet prior to a mint event.

Minting requires a one-time XRP payment. All minting fees are final and non-refundable once submitted to the XRP Ledger. We are not responsible for XRP sent to incorrect addresses or for failed transactions caused by network issues outside our control.

Community board posts that have been minted as NFTs cannot be deleted. All secondary sales carry a 5% creator royalty via XLS-20 TransferFee.

Holding a Frito Flames NFT does not grant ownership of the LilFrito brand, the right to create commercial derivatives, governance rights, revenue share, or any guaranteed future utility. We strongly discourage purchasing NFTs with the expectation of financial gain.

6. Platform Tokens

Platform tokens ("Tokens") are virtual in-platform credits. They are not cryptocurrency, currency, securities, or financial instruments. Tokens cannot be withdrawn, cashed out, transferred between users, or exchanged for real money or XRP. They are non-refundable and hold no value outside this Platform.

Token packages are optionally available for users who wish to generate more Flames. All token purchases are final and non-refundable. We reserve the right to change token costs, amounts, or discontinue the token system at any time.

7. Rarity, XP & Leveling

Flame rarity is determined server-side. Displayed odds represent approximate probabilities, not guarantees. Legendary Surge events may be activated, modified, or deactivated at any time. XP and player levels are in-platform recognition metrics with no monetary value. We reserve the right to modify or reset any aspect of the XP and leveling system at any time.

8. The Firepit — Arcade Games

Game sessions may require tokens. One free daily play is provided as a courtesy and may be modified or removed at any time. Leaderboard positions carry no monetary value. We employ automated anti-cheat systems — our determination of what constitutes cheating is final. Games may be added, paused, or removed at any time without liability for tokens spent.

9. LilCommunity — Board, Competitions & Voting

By posting a Flame to the community board, you grant LilFrito a perpetual, royalty-free license to display and promote it. We may remove any post at any time without notice or compensation. Community posts may not include obscene, sexually explicit, or violent content; content that targets or harasses any individual; content promoting illegal activity; or content that impersonates any person or entity. Violations will result in post removal and may result in account termination.

Competition Entry Rules: One entry per account per competition. Entries may be replaced only before receiving any votes. Once an entry receives a vote, it is locked for that competition. A Flame entered in a previous competition cannot be re-entered in any future competition. Entries must be original Flames generated by the entrant on this Platform.

Voting Rules: One vote per account per competition — final once cast. You cannot vote for your own entry. We reserve the right to invalidate votes determined to be fraudulent or coordinated.

Competition Administration Rights: We reserve the right at our sole discretion to start, pause, extend, cancel, or void any competition at any time, disqualify any entrant for any reason, adjust or decline giveaway distributions in cases of fraud or technical error, and make final determinations on all disputed outcomes.

LilFrito competitions are skill-based community contests, not games of chance. Winners are determined by community vote, not random selection. No purchase is required to enter a competition.

10. XRP Community Giveaways

No purchase of any kind is required for eligibility. Free daily tokens ensure every user can participate at no cost.

XRP giveaways are distributed manually by the platform operator at their own discretion. We aim to distribute within 7 business days but make no guarantee. To receive an XRP distribution, you must have a valid XRPL wallet address on file. Wallet account holders are eligible by default. Email account holders must link a valid XRPL wallet to their account before a giveaway is distributed — failure to do so forfeits the distribution for that event, with no obligation to redistribute. Giveaways may additionally be withheld if the recipient's wallet is invalid or unlinked, the recipient violated these Terms, technical or legal factors prevent distribution, or we determine unfair conduct occurred.

Recipients are solely responsible for any tax obligations. XRP distributions are voluntary, discretionary gifts — they do not constitute gambling, lottery, wagering, or any regulated financial activity.

11. LilFrito Genesis NFT Collection

LilFrito Genesis NFTs are 90 limited-edition NFTs on the XRP Ledger (XLS-20, Taxon 1). Holding a Genesis NFT grants ownership of the on-chain token and personal, non-commercial rights to display the artwork. It does not grant ownership of the LilFrito brand, commercial derivative rights, governance rights, revenue share, or guaranteed future utility.

Hoodie Redemption: One (1) exclusive hoodie per NFT, subject to a redemption window opened at our discretion (minimum 72 hours notice). One redemption per NFT per lifetime, non-transferable once claimed. Hoodie design, sizing, and availability at our discretion. International shipping where operationally possible. We are not responsible for packages after carrier handoff.

All secondary sales carry a 5% creator royalty. Genesis NFTs are digital collectibles — do not purchase as a financial investment.

12. FritoMart — Merchandise

FritoMart is the official LilFrito merchandise store. When available, all drops are limited edition and will not be restocked once sold. All sales are final unless an item arrives damaged or defective — contact lilfritoxrp@gmail.com within 7 days of delivery with photo evidence of damage. We are not responsible for shipping delays or loss once dispatched to the carrier. We reserve the right to cancel any order due to pricing errors, stock issues, or suspected fraud, and will issue a full refund in such cases. FritoMart features may be available, paused, or discontinued at any time without notice.

13. Intellectual Property

The LilFrito name, logo, character design, Fritoverse concept, and all associated branding are the intellectual property of the platform operator. No part may be reproduced, distributed, or used commercially without written permission. The LilFrito character was originally derived from a $Phnix NFT, used with permission of the original artwork creator, Dale (@dfart2287). Dale is not affiliated with, does not govern, and holds no ownership interest in the LilFrito platform or any associated products, collections, or revenue.

14. Prohibited Conduct

The following are strictly prohibited and will result in immediate, permanent account restriction without notice, refund, or appeal:

• Using bots, scripts, or automated tools to generate Flames, farm tokens, exploit XP, or manipulate competition outcomes
• Coordinating votes with other users ("vote trading," sock puppet accounts, or organized voting rings)
• Creating multiple accounts — email, wallet, or Discord — to circumvent Platform rules or gain additional tokens, XP, competition entries, or giveaway eligibility
• Entering a previously competed Flame in a new competition
• Providing false, misleading, or fraudulent information to the Platform or its users
• Impersonating the LilFrito team, moderators, or any other user
• Attempting to reverse-engineer, hack, exploit, or disrupt Platform infrastructure
• Posting content that is obscene, defamatory, threatening, or violates any law
• Promoting other blockchain projects, tokens, or NFT collections without written permission
• Using the Platform for any activity that violates applicable laws in your jurisdiction

15. Moderation & Enforcement

LilFrito is the final decision-maker on all moderation matters — including bans, content removal, vote invalidation, competition results, and giveaway eligibility. Our decisions are final and not subject to appeal. We may restrict, suspend, or permanently ban any user or wallet at any time, for any reason, without explanation or compensation. Upon permanent ban, all associated in-platform assets — including token balances, XP, and Flame history — are forfeited without refund. We will cooperate fully with applicable law enforcement in any investigation of illegal activity.

16. Disclaimers

THE PLATFORM AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND — EXPRESS, IMPLIED, OR STATUTORY — INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not guarantee continuous or uninterrupted Platform access, the value of XRP or any associated digital asset, the availability of any specific feature or game, or the behavior of any third-party service including Supabase, Xaman, Vercel, Railway, the XRP Ledger, or AI generation providers.

No Financial or Investment Advice. Nothing on this Platform — including any content, features, XRP giveaway amounts, NFT descriptions, token values, or community discussion — constitutes financial, investment, tax, or legal advice of any kind. We are not licensed financial advisors. Any decision you make involving XRP, NFTs, or digital assets is made entirely at your own risk. You should consult a qualified professional before making any financial decisions.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LILFRITO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING LOSS OF REVENUE, PROFITS, DATA, TOKENS, XP, NFTS, OR DIGITAL ASSETS.

IN ALL CASES, OUR MAXIMUM TOTAL LIABILITY TO ANY USER SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO LILFRITO IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

18. Indemnification

You agree to indemnify, defend, and hold harmless LilFrito and its operator, affiliates, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from your use of the Platform, violation of these Terms, violation of any third-party rights, content you submit or post, or violation of any applicable law.

19. Dispute Resolution

Informal resolution first. Before initiating any formal proceeding, contact us at lilfritoxrp@gmail.com and attempt to resolve the dispute informally. We will respond in good faith within 30 days.

Small claims. Either party may bring an individual claim in small claims court in Colorado, provided the claim qualifies under that court's jurisdictional limits. This exception does not apply to class or representative claims.

Binding arbitration. For all other disputes, if informal resolution fails, the matter shall be resolved exclusively through binding individual arbitration under the rules of the American Arbitration Association (AAA), conducted in English. You waive your right to participate in any class action lawsuit or class-wide arbitration. Each party is responsible for their own attorneys's fees unless the arbitrator determines otherwise.

Governing law. These Terms are governed by and construed in accordance with the laws of the United States and the State of Colorado, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of courts located in Colorado for any matter not subject to arbitration.

Limitation period. Any claim must be initiated within one (1) year of the event giving rise to it — claims not brought within this period are permanently and irrevocably barred.

20. Privacy

What we collect:

• Email accounts: email address, hashed password (managed by Supabase Auth — we never see your raw password), platform activity, and any linked XRPL wallet address
• Wallet accounts: XRPL wallet address used as your account identifier
• All accounts: Discord user ID and username (when linked), IP address hashes (for fraud and moderation), and in-platform activity including Flames generated, games played, votes cast, and competition entries

What we do not collect: Raw passwords, private keys, seed phrases, financial account numbers, or government identification of any kind.

How we use it: To operate the Platform, authenticate your account, enforce these Terms, prevent fraud and abuse, and send platform-related communications to opted-in users. Email addresses are used for account authentication and platform notifications only — never sold or shared for marketing.

Cookies & analytics: We use Google Analytics (via Google Tag Manager) to collect anonymized usage data — pages visited, session duration, and general geographic region. This data helps us understand how the Platform is used and improve it. Google Analytics uses cookies and similar tracking technologies. You may opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on or by using a browser with tracking protection enabled. We do not use advertising cookies or sell analytics data.

Email communications: If you create an email account, we may send you transactional emails (account verification, password reset) and, if you opt in, platform update notifications. You may unsubscribe from non-transactional emails at any time by clicking the unsubscribe link in any email or by contacting lilfritoxrp@gmail.com. Transactional emails (such as password resets) cannot be opted out of, as they are necessary for account security and operation.

Third-party processors: Supabase (database and authentication), Vercel (web hosting), Railway (Discord bot hosting), Google Analytics (anonymized usage analytics). We do not sell, rent, or trade your personal information to third parties for marketing purposes.

Notification list: If you submit your email address via any "Notify Me" or newsletter form on the Platform (including the footer form), we store that address solely to send you platform updates and new drop notifications. You may unsubscribe at any time by contacting lilfritoxrp@gmail.com. We do not share these addresses with third parties.

Data breach notification: In the event of a data breach that affects your personal information, we will notify affected users as required by applicable law, using the email address on file where possible.

Data deletion: Contact lilfritoxrp@gmail.com to request deletion of your off-chain Platform data, including your email account and associated records. Supabase Auth account data will be permanently deleted upon request. On-chain data — wallet addresses, NFT records, and XRP transactions — exists permanently on the XRP Ledger and cannot be deleted by us or anyone else.

21. Frito's Nest Discord — Community Standards

Zero tolerance — immediate permanent ban (no warning or appeal):

• Sharing phishing links, wallet-draining contracts, or scam content of any kind
• Impersonating LilFrito team members, moderators, or other users
• Asking for or sharing XRPL private keys or seed phrases
• Posting sexually explicit, illegal, or violent content
• Coordinated harassment, threats, or targeted abuse of any member

General rules: Treat all members with respect. Do not advertise other blockchain projects without written permission. Do not DM members unsolicited. Verify your wallet via /verify to participate in most channels. Providing false wallet information to gain access is a ban-worthy offense. Moderation decisions are final.

22. Platform Rights — Reserve Clause

LilFrito unconditionally and expressly reserves the following rights at all times, without limitation:

1. Modify any feature — including token costs, XP formulas, game mechanics, rarity odds, competition rules, and giveaway structures — at any time without notice or liability
2. Shut down the Platform — temporarily or permanently, at any time, without liability for tokens, XP, in-progress competitions, expected giveaways, or Platform access
3. Ban any user — permanently or temporarily, for any reason, without explanation, notice, or compensation
4. Cancel or void any competition — including declining all giveaway distributions, reversing results, or declaring no recipients, for any operational or discretionary reason
5. Modify or cancel giveaways — at any time before distribution, including reducing amounts to zero
6. Adjust the token economy — including daily token amounts, costs, and optional purchase pricing, at any time
7. Remove any content — including Flames, board posts, or user-generated content, at any time without compensation
8. Modify these Terms — at any time; continued use constitutes acceptance
9. Transfer or sell the Platform — including all user data and infrastructure, to a successor entity
10. Decline any giveaway — if we have reasonable basis to believe a recipient engaged in fraud, manipulation, or Terms violation
11. Cease NFT-related services — including the Frito Flame minting mechanism, at any time; previously minted NFTs remain on-chain independently
12. Modify or close any feature — including the Flame Factory, Firepit, community board, or competitions, at any time and for any duration
13. Purge inactive accounts — email or wallet accounts with no login activity for 18 consecutive months may be removed, along with associated off-chain data including tokens, XP, and Flame history. On-chain NFTs are unaffected. We will make reasonable efforts to notify the email address on file before purging an email account.

23. No Gambling Representation

LilFrito is a creative community platform. We represent and affirm that:

• No purchase is necessary to participate in any Platform feature, including competitions and giveaways. Free daily tokens are maintained to ensure perpetual free access.
• LilCommunity competition winners are determined by community vote — a participation and engagement-based metric, not random chance. This constitutes a skill-based contest, not a lottery.
• Firepit arcade leaderboard rankings are determined entirely by player skill and score — outcomes are based on performance, not random chance, and do not constitute gambling of any kind.
• XRP distributions are voluntary gifts made at the sole discretion of the platform operator. They are not prizes, winnings, contractual rewards, or guaranteed outcomes.
• The Platform does not operate a lottery, casino, raffle, or any form of legalized gambling activity.
• Users are individually responsible for verifying that participation in this Platform and receipt of any community giveaway is lawful in their jurisdiction.

24. Changes to These Terms

We may revise these Terms at any time by posting an updated version with a revised "Last Updated" date. For material changes, we will make reasonable efforts to notify users via the website or Frito's Nest Discord. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, your sole remedy is to stop using the Platform and, if applicable, delete your account.

Severability: If any provision is found invalid or unenforceable, the remaining provisions continue in full force and effect.

Entire Agreement: These Terms — including the Privacy section in §20 and the Community Standards in §21 — constitute the entire agreement between you and LilFrito regarding your use of the Platform and supersede all prior agreements.

No Waiver: Failure to enforce any provision shall not constitute a waiver of our right to enforce it in the future.

26. DMCA & Copyright Takedown

LilFrito respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on this Platform infringes your copyright, please submit a written notice to lilfritoxrp@gmail.com containing:

• A description of the copyrighted work you claim has been infringed
• A description of where the allegedly infringing material is located on the Platform
• Your contact information (name, address, phone number, and email)
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
• Your physical or electronic signature

Upon receipt of a valid DMCA notice, we will investigate and, where appropriate, remove or disable access to the allegedly infringing content. We reserve the right to terminate accounts of users who are repeat infringers.

AI-Generated Content Notice: Flames generated on the Platform are created by third-party AI models using a proprietary LilFrito character prompt. We make reasonable efforts to ensure our AI usage complies with applicable law. If you believe a generated Flame infringes your intellectual property, contact us using the process above.

Counter-Notice: If you believe content was removed in error, you may submit a counter-notice to lilfritoxrp@gmail.com. We will process counter-notices in accordance with applicable DMCA procedures.

27. Force Majeure

LilFrito shall not be liable for any failure or delay in performance caused by events beyond our reasonable control — including but not limited to XRP Ledger outages or protocol changes, failure of third-party services (Supabase, Vercel, Railway, Xaman, or AI providers), government actions or regulatory changes affecting XRP or NFTs, cyberattacks, natural disasters, pandemics, or internet infrastructure failures. In any such event, we may delay, modify, cancel, or suspend any Platform feature, competition, giveaway, or NFT mint without liability, and will restore services as soon as reasonably practicable.

28. Feedback & Suggestions

If you submit ideas, feedback, feature requests, suggestions, comments, or other input about the Platform ("Feedback") — whether through Discord, email, social media, or any other channel — you agree that:

• All Feedback is provided voluntarily and without any expectation of compensation
• LilFrito may use, implement, modify, and commercialize any Feedback without restriction, attribution, or payment to you
• LilFrito owns all rights, title, and interest in any improvements, features, or products developed based on or inspired by your Feedback
• You waive any moral rights or claims of authorship over implemented Feedback
• You do not retain any intellectual property rights in Feedback once submitted

Submitting Feedback does not create any employment, partnership, or agency relationship between you and LilFrito, and does not entitle you to any compensation, revenue share, or platform equity.
